Terms and Conditions

These Terms govern your access to and use of Outfitcheck Style services, including the website, application, and associated API. By using the Services, you accept these Terms in their entirety.

Acceptance and Eligibility

By using the Service, you accept these Terms and our Privacy Policy. You must be at least 16 years old or the minimum digital consent age in your jurisdiction, whichever is higher. If you use the Service on behalf of an organization, you confirm that you are authorized to bind the organization to these Terms.

Service Description

We provide AI-powered virtual try-on and outfit planning services. Input data may be processed through third-party AI processing infrastructure and supporting providers to deliver your requested outputs. Due to the nature of AI, results may vary, may not be unique across users, and are not guaranteed to be accurate or suitable for any particular purpose.

Acceptable Use

You may only use the Service for lawful purposes. You must hold rights or explicit consent for any images of identifiable individuals you upload. Strictly prohibited uses include: sexually explicit content or nudity, content involving minors in any harmful or exploitative way, deceptive imagery of real identifiable individuals without their consent, content promoting violence, extremism, or illegal activities, infringement of third-party intellectual property rights, using the Service to build a competing product or resell access without prior written consent, and any use that disrupts or overloads the Service infrastructure.

Your Content and AI Outputs

You retain full ownership of uploaded content. By using the Service, you grant Outfitcheck Style a limited, non-exclusive, royalty-free license to process, store, and deliver your content solely for the purpose of providing the Service. This license ends when you delete the content or your account. Generated outputs may be used for personal or commercial purposes according to your active plan, subject to the rights you hold in the input content. Outfitcheck Style does not claim ownership of outputs generated from your content.

AI Labeling and Transparency

All generated results are synthetic content produced by artificial intelligence. A visible indicator is displayed on generated results within the platform in accordance with Article 50 of the EU AI Act (Regulation (EU) 2024/1689). You must not remove, hide, or misrepresent AI-origin labeling when sharing generated content publicly. You are responsible for how you use and distribute generated outputs.

Billing and Credits

Credits and paid packages are billed through third-party payment processors. Digital access is granted immediately after purchase. By completing a purchase, you expressly request immediate access to digital content and acknowledge that your right of withdrawal lapses upon access being granted, in accordance with Art. 16(m) of Directive 2011/83/EU and applicable Romanian law. Unless required by mandatory applicable law, payments are non-refundable after access is granted. Subscriptions renew automatically monthly or annually depending on the selected plan, unless canceled before the end of the current period. Top-up credits expire 12 months from purchase. Applicable expiry rules and renewal details are shown at checkout and in your active plan details.

Termination and Enforcement

We may suspend or terminate access without prior notice in cases of serious Terms violations, abuse, fraud, security risk, or at the request of competent authorities. For minor violations, we will make reasonable efforts to notify before suspension. You may stop using the service and delete your account at any time from the application settings.

Disclaimer and Liability Limits

The Service is provided "as is" and "as available." AI outputs may contain inaccuracies, visual artifacts, or imperfect fits and are not guaranteed for styling or purchasing decisions. You are responsible for validating outputs before use or distribution. To the extent permitted by applicable law, Outfitcheck Style's total liability to you for any claim is limited to the value of payments made in the 12 months preceding the event giving rise to the claim.

Governing Law and Disputes

These Terms are governed by Romanian law and applicable European Union law. Competent Romanian courts have jurisdiction over any dispute, subject to mandatory consumer protection rules in your jurisdiction.

Changes to These Terms

We reserve the right to modify these Terms. Material changes will be communicated at least 14 days before taking effect. Continued use of the Service after notification constitutes acceptance of the updated Terms.
